1. Acceptance of Terms

By using Nandey Content, you agree to these Terms of Service, our Privacy Policy, and any additional terms that may apply. These Terms constitute a legally binding agreement between you and Nandey Content, operated by Stefan Burger, Siegfriedgasse 4, 1210 Wien, Austria.

2. Description of Service

Nandey Content provides social content creation and editing services. We transform your raw photos, video clips, and ideas into polished, ready-to-post content for social media platforms including Instagram, TikTok, YouTube, LinkedIn, and others.

3. Eligibility

You must be at least 18 years old or have parental/guardian consent to use our services. By using the Service, you represent and warrant that you meet these requirements.

4. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Content Ownership

You retain full ownership of all content you upload and all content we create for you. By uploading content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service. Once we deliver the finished content to you, all rights transfer to you completely.

6. Prohibited Use

You agree not to use the Service to:

• Upload or share unlawful, harmful, defamatory, or offensive content.
• Infringe on the intellectual property rights of others.
• Misrepresent your identity or affiliation.
• Attempt to reverse engineer, disrupt, or abuse the platform.
• Use the Service for any illegal purpose.

7. Intellectual Property

All branding, website design, and software associated with Nandey Content (excluding user content and delivered work) are owned by Nandey Content and are protected by copyright and other intellectual property laws.

8. Payments, Subscriptions & Billing

All payments are processed securely by Stripe, a PCI-DSS Level 1 certified payment processor. Charges are displayed in euros (EUR) unless otherwise stated. By purchasing a subscription, you authorize us (and Stripe on our behalf) to charge your selected payment method for the applicable amount, including any applicable taxes. Subscriptions renew automatically at the end of each billing period unless cancelled.

9. Refunds & Cancellations

You may cancel your subscription at any time via your account dashboard or by contacting us at support@ndey-content.com. Upon cancellation, your subscription will remain active until the end of the current billing period.

Refunds may be issued on a case-by-case basis for the current billing period if no content has been delivered during that period. To request a refund, email support@ndey-content.com from the address associated with your account within 14 days of the charge. Approved refunds are credited to the original payment method within 5 to 10 business days.

10. Chargebacks & Disputes

If you initiate a chargeback or payment dispute, we may suspend your account until the matter is resolved. We reserve the right to contest any illegitimate chargebacks and to recover any associated fees.

11. Payment Security

We do not store complete credit card numbers or CVC codes on our servers. All payment information is transmitted directly to Stripe via industry-standard encryption. You acknowledge and agree that Stripe is responsible for the security of your payment data.

12. Delivery & Revisions

We aim to deliver content within the timeframes specified in your subscription plan. You may request reasonable revisions to delivered content. The number of revision rounds included depends on your subscription tier.

13. Termination

We reserve the right to suspend or terminate your access to the services at our discretion and without notice if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users.

14. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee that the services will be error-free, uninterrupted, or meet your specific requirements.

15. Limitation of Liability

To the fullest extent permitted by law, Nandey Content shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the services, including but not limited to loss of profits, data, or business opportunities.

16. Indemnification

You agree to indemnify and hold harmless Nandey Content and its owner from any claims, damages, or expenses (including reasonable legal fees) arising out of or related to (i) your violation of these Terms, (ii) the content you upload, or (iii) your misuse of the services.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the services after changes constitutes acceptance of the updated Terms.

18. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Austria. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Vienna, Austria.
